These Conditions of Sale (hereinafter referred to as General Conditions) govern the terms and conditions of sale of the products marketed (hereinafter referred to as Products) by Azienda Agricola Lunigiana Tartufo di Simone Mori. All contracts for the sale of products by Azienda Agricola Lunigiana Tartufo di Simone Mori to third parties (Customers) are governed by these general conditions, which form an integral and substantial part of every proposal, order and order confirmation for the purchase of the products themselves.

Unless otherwise indicated, prices of products published by Azienda Agricola Lunigiana Tartufo di Simone Mori must be understood to include VAT.
The prices of products from time to time published by Azienda Agricola Lunigiana Tartufo di Simone Mori cancel and replace previous ones and are subject to the actual availability of the products.
Azienda Agricola Lunigiana Tartufo di Simone Mori reserves the right to confirm or change the prices of products published on its website, at the time of confirmation of the Customer’s order.

Products are not provided on a trial basis. Although Azienda Agricola Lunigiana Tartufo di Simone Mori may provide guidance on product characteristics, the Customer is responsible for the choice of products ordered. Images of the Products are indicative and not binding.

Any special offers promoted by Azienda Agricola Lunigiana Tartufo di Simone Mori are valid while stocks last and, in any case, are subject to the actual availability of the relevant products at Azienda Agricola Lunigiana Tartufo di Simone Mori. No assistance or replacement is provided in connection with any products received as gifts from Azienda Agricola Lunigiana Tartufo di Simone Mori.

Payment Methods

PayPal

In cases of purchasing goods with PayPal payment method (fast and secure payment system of the eBay group), the buyer will be redirected to the PayPal site where they can complete the order and make the payment by accessing their account (by entering their personal e-mail address and password) or by creating a new account easily and immediately.
By choosing to pay with PayPal, the amount is charged directly to the assigned credit card (Visa, Visa Electron, Mastercard) or prepaid card (PostePay). PayPal protects buyer information in that no financial information is passed.
A confirmation e-mail from PayPal will be sent with each transaction made by this method. The amount of the order is debited from the PayPal account when the order is taken. In case of cancellation the amount is refunded to the customer’s PayPal account.

Acceptance of orders

All product purchase orders sent to Azienda Agricola Lunigiana Tartufo di Simone Mori must be complete in every part and must contain all the elements necessary for the correct identification of the products ordered. Each product order transmitted to Azienda Agricola Lunigiana Tartufo di Simone Mori constitutes a contractual proposal from the Customer and, therefore, will be binding on Azienda Agricola Lunigiana Tartufo di Simone Mori only if confirmed by it for acceptance.

Fulfillment of the order by Azienda Agricola Lunigiana Tartufo di Simone Mori is equivalent to confirmation and acceptance thereof. Azienda Agricola Lunigiana Tartufo di Simone Mori reserves the right not to accept incomplete, not properly filled orders. In such a case, the Customer shall not be entitled to any refund or indemnity or compensation whatsoever.

Tax documentation for the products ordered will be issued by Azienda Agricola Lunigiana Tartufo di Simone Mori when the products are shipped to the Customer. If the Customer has a VAT number and wishes to receive an invoice in his or her own name, he or she must indicate this request in the order. In default, Azienda Agricola Lunigiana Tartufo di Simone Mori will not issue a tax invoice.

Successful receipt of the Customer’s proposal is confirmed by Azienda Agricola Lunigiana Tartufo di Simone Mori by means of an automatic response sent to the e-mail address provided by the Customer. The response from Azienda Agricola Lunigiana Tartufo di Simone Mori is generated automatically by the Site system and only confirms the correct receipt of the proposal within the information systems. The message repeats, in addition to the information required by law, all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections.

Each Purchase Contract entered into between Azienda Agricola Lunigiana Tartufo di Simone Mori and the Customer shall be deemed concluded with the acceptance of the order by Azienda Agricola Lunigiana Tartufo di Simone Mori. Azienda Agricola Lunigiana Tartufo di Simone Mori has the right to accept or not, at its own discretion, the order sent by the Customer, without the latter being able to make claims or rights of any kind, for any reason whatsoever, including compensation, in the event of non-acceptance of the order. Acceptance shall be deemed to be tacitly issued unless otherwise communicated to the Customer within 48 hours of placing the order, by means of an e-mail message sent to the address provided by the Customer.

Mode of delivery

Deliveries are normally made by Courier
Estimated delivery times are between 3 and 4 days (excluding orders straddling holidays, which may be delayed by about 3 or 4 days).
The delivery days indicated are to be considered “working” days, keeping in mind that on Saturdays, Sundays and holidays deliveries are not made.

The delivery terms provided by Azienda Agricola Lunigiana Tartufo di Simone Mori, while carefully considered, are to be understood as not binding on Azienda Agricola Lunigiana Tartufo di Simone Mori, which may subsequently confirm or modify them, depending on its actual availability and/or needs.

Any delays in delivery of less than 10 days do not entitle the Customer to refuse delivery of the products, nor to claim compensation or indemnity of any kind.

Azienda Agricola Lunigiana Tartufo di Simone Mori has the right to make the delivery of the products (even relating to the same order) in several successive deliveries without prejudice, in this case, to a single charge to the Customer by way of transport costs.
Special terms and conditions of delivery must be agreed in advance between the Customer and Azienda Agricola Lunigiana Tartufo di Simone Mori and accepted in writing by Azienda Agricola Lunigiana Tartufo di Simone Mori.

Payment for the goods by the Customer will be made using the method chosen when placing the order. No additional fees or charges are due to Azienda Agricola Lunigiana Tartufo di Simone Mori.

Home delivery by the Courier, is made during normal business hours, we suggest giving a safe delivery address, where there is someone who can receive the shipment.
In case of “non-delivery,” the courier will leave a notice to indicate a new date and time for the next delivery attempt, or allow the package to be picked up at the nearest courier location.
The User may indicate any special requests about the delivery method within the “Notes” box during the order formalization wizard. In addition, it is important to give the name listed on the intercom and a telephone number so that the courier or our Customer Service Department can contact the buyer if needed.

Product delivery is intended to be at street level. Upon delivery of the products by the courier appointed by Azienda Agricola Lunigiana Tartufo di Simone Mori, the Customer is required to check:

1. That the number of packages being delivered corresponds to what is indicated in the transport document
2. That the packaging is intact, undamaged or otherwise altered, including the sealing materials

Any damage to the packaging and/or the products or the mismatch in the number of packages or indications must be immediately contested by the Customer, putting the words “ACCEPTED WITH RESERVE” on the courier’s delivery receipt. In addition, the Customer agrees to promptly report – and in any case no later than 8 (eight) days from the date of delivery – to Azienda Agricola Lunigiana Tartufo di Simone Mori Mori any problem concerning the physical integrity, or completeness of the products received.

Right of withdrawal

Pursuant to Legislative Decree 206/2005, the Customer (if he/she qualifies as a “consumer” within the meaning of Article 1 letter b) has the right to withdraw from the contract and return the products ordered, without penalty and without specifying the reason, within the term of 14 (fourteen) calendar days from receipt of the products.

The right of withdrawal referred to in the preceding D. Lgs 206/2005 must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with return receipt to
Azienda Agricola Lunigiana Tartufo di Simone Mori, within 14 (fourteen) calendar days of receipt of the products. The above notice may also be sent, within the same period, by telegram or fax, provided it is confirmed, by registered letter with return receipt, within 48 (forty-eight) hours after the telegram or fax is sent.

All returns (which must be perfectly intact and accompanied by the original packaging) must be authorized by Azienda Agricola Lunigiana Tartufo di Simone Mori who will issue a return authorization number (RMA).

Once the products have been received (and their integrity verified) Azienda Agricola Lunigiana Tartufo di Simone Mori will, as soon as possible, and in any case within 30 working days of receipt of the goods, credit the Customer with the cost of the returned products (as indicated on the invoice), withholding, where necessary, the amount of shipping costs that will remain definitively borne by the Customer.

The right of withdrawal referred to in Legislative Decree 206/2005 cannot be exercised by the Customer if the purchased products have been used (or damaged) by the Customer.

The right of withdrawal also does not apply to the Customer who purchases for purposes related to his business (e.g.: instrumental use, resale, etc.) and therefore communicates to Azienda Agricola Lunigiana Tartufo di Simone Mori his VAT number.

Finally, the right of withdrawal is excluded in the following cases:

• Purchase of packaged products, the original packaging of which has been tampered with or damaged by the Customer;
• Purchase of products on special offer.

Read applicable

Without prejudice to the possible applicability of mandatory provisions of law placed to protect consumers (as defined in accordance with Legislative Decree 206/2005), any dispute however related to these General Conditions, will be devolved to the exclusive jurisdiction of the COURT OF MASSA.

Pursuant to and in accordance with articles 1341 and 1342 of the Civil Code, the Customer declares that he/she has carefully read and understood and specifically accepts the following clauses of the General Terms and Conditions of Sale of Azienda Agricola Lunigiana Tartufo di Simone Mori.
